Legal Precedent Set: Kerala Court Pronounces Guilty Verdict in Case of Minor Riding Motorcycle

A man in Kerala has been sentenced by Additional Chief Judicial Magistrate Naina KV for allowing his younger brother to operate his motorcycle.

The court imposed a punishment of simple imprisonment until the next court date along with a fine of 34,000 rupees. ADCJM Naina KV took into account the fact that the man allowed his sibling to ride the motorcycle without displaying the required license plates on the front and rear.

Consequently, the magistrate ordered a one-year revocation of the vehicle’s registration and a three-month suspension of the man’s license. The case originated from a consumer complaint filed against the man by the Assistant Motor Vehicles Inspector, Regional Transport Office (enforcement), Kakkanad.

The complaint accused the man of violating the Central Motor Vehicle Rules and the Motor Vehicles Act, 1988, claiming that his minor brother rode the motorcycle with his consent and knowledge, without proper license plate display, sari protector, direction indicator lamp, and rearview mirrors.

The man admitted his guilt, resulting in his imprisonment until the court adjourned for the day and a total fine of 34,000 rupees for the offenses he was found guilty of.
